Terms of Service
Review the contractual framework for using Arctavia, operated by UK-based Dandeleon Ltd.
1. Definitions
“Service” means Arctavia and all related APIs, dashboards, and tooling. “Customer” means any individual or entity using the Service. Additional terms such as Amazon Ads account and Customer Data carry the meanings set out herein.
2. Acceptance
By accessing Arctavia you agree to these Terms. Ancillary guidelines, help docs, and in-product notices form part of this agreement. In the event of conflict, the English version controls.
3. Accounts
Customers must provide accurate registration data and protect credentials. Unauthorised use must be reported immediately.
4. Service description
Arctavia connects to Amazon Ads to deliver ML/LLM-assisted bid review drafts, keyword workflow suggestions, dashboards, and insights. Customer approval may be required before changes are applied. Outcomes such as increased sales are not guaranteed.
5. Fees & billing
Fees follow the published plan or written order. Free trials are subject to posted conditions. Non-payment may result in suspension. Fees already paid are non-refundable unless required by law.
6. Prohibited use
You must not violate laws or Amazon policies, resell the Service, reverse engineer, overload infrastructure, or engage in any activity that infringes rights or compromises security.
7. Third-party services
The Service relies on Amazon Ads APIs and other processors. Their policies apply. API outages, throttling, or changes may impact functionality.
8. Suspension
We may suspend the Service for maintenance, emergencies, force majeure events, or other unavoidable reasons. We are not liable for resulting damages except in cases of wilful misconduct or gross negligence.
9. Termination
We may terminate or suspend accounts that violate these Terms, fail to pay fees, or are reasonably suspected of being involved with prohibited activity or unlawful conduct.
10. Data handling
Customer Data remains yours. We may process it to operate and improve the Service. We do not provide access to other sellers' data or cross-customer data.
11. Privacy
Personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.
12. Intellectual property
All IP in Arctavia belongs to Dandeleon Ltd or its licensors. No rights are granted beyond the limited licence to use the Service.
13. Disclaimer
The Service is provided “as is”. We do not warrant uninterrupted availability, freedom from errors, or suitability for a particular purpose. LLM insights are probabilistic and provided without guarantee.
14. Liability
Our liability is limited to the fees paid to us in the preceding 12 months. We are not liable for indirect, consequential, or lost-profit damages.
15. Changes
We may update these Terms. Continued use after the effective date constitutes acceptance of the revised Terms.
16. Assignment
Customers may not assign or transfer their rights or obligations without our prior written consent.
17. Anti-bribery & AML
You represent and warrant that you are not part of, or providing funds to, any sanctioned or criminal organisation. We may terminate immediately upon breach.
18. Governing law
These Terms are governed by the laws of England and Wales. The courts of London have exclusive jurisdiction.
